roverIQ™ is a trademark of roverIQ, Inc. (“roverIQ™,” “roverIQ, Inc.,” “we,” “us,” or “our”). roverIQ, Inc. provides software-as-a-service products, artificial intelligence systems, and related services (collectively, the “Services”). This Privacy Policy explains how we collect, use, disclose, and safeguard information when you access www.roveriq.ai (the “Site”), use the Services, or otherwise interact with roverIQ™.

BY ACCESSING OR USING THE SITE OR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THIS PRIVACY POLICY, INCLUDING THE ARBITRATION AGREEMENT, CLASS ACTION WAIVER, JURY TRIAL WAIVER, AND PAGA WAIVER SET FORTH BELOW. IF YOU DO NOT AGREE, YOU MUST NOT USE THE SITE OR SERVICES.

You may voluntarily provide:

  • Identifiers: name, email address, username, password, company or organization details

  • Contact Information: email address, mailing address, mobile phone number

  • Billing & Transaction Data: billing address and payment details (processed by third-party payment processors; roverIQ, Inc. does not store full payment card numbers)

  • User Content: prompts, text, files, uploads, data inputs, outputs, or other content submitted through the Services

  • Communications: support requests, feedback, surveys, or correspondence

You represent and warrant that you have the legal authority to provide such information and that it does not violate any law or third-party rights.

 

1.2 Information Automatically Collected

We may automatically collect:

  • Internet / Network Activity: pages viewed, features used, timestamps, session duration, referring URLs

  • Device & Technical Data: IP address, browser type, operating system, device identifiers, cookies, pixels, and similar technologies

  • Log & Security Data: authentication logs, error logs, audit logs, and diagnostics

 

1.3 Information from Third Parties

We may receive information from analytics providers, payment processors, and integration partners you authorize.

Mobile phone numbers, SMS opt-in data, and SMS consent records are never sold or shared with third parties for marketing or promotional purposes. Any references to “sharing” in this Policy expressly exclude SMS originator opt-in information.

 

2. SMS Messaging, TCPA & 10DLC Compliance

By voluntarily providing your mobile phone number, you expressly consent to receive marketing, transactional, and informational SMS messages from roverIQ™ at the number provided, including messages sent using an automatic telephone dialing system, in compliance with the Telephone Consumer Protection Act (TCPA) and 10DLC carrier requirements.

AI outputs are probabilistic and may be inaccurate. roverIQ™, on behalf of roverIQ, Inc., disclaims all liability for reliance on AI-generated outputs.

We do not sell personal information.

We may share information with:

  • Service providers under contractual confidentiality obligations

  • Successor entities in mergers, acquisitions, or asset sales

  • Authorities or third parties as required by law or to protect roverIQ, Inc.’s legal interests

 

5. Cookies & Tracking Technologies

We use cookies and similar technologies for authentication, analytics, personalization, and security. Disabling cookies may impair functionality. roverIQ™, on behalf of roverIQ, Inc., disclaims liability for service degradation caused by user-controlled settings.

 

6. Data Retention

We retain information as reasonably necessary for business, legal, compliance, and operational purposes. Deletion requests are subject to legal, contractual, backup, and security requirements.

 

7. Data Security Disclaimer

We employ commercially reasonable safeguards. No system is completely secure.
You acknowledge and agree that roverIQ, Inc. disclaims liability for unauthorized access, breaches, or security incidents beyond our reasonable control.

 

8. International Transfers (GDPR)

Information may be transferred to and processed in the United States or other jurisdictions. Where applicable, roverIQ, Inc. relies on lawful transfer mechanisms.

 

9. Privacy Rights

9.1 California Residents (CCPA / CPRA)

California residents may have rights to access, correct, delete, or limit the use of personal information. roverIQ, Inc. does not sell personal information.

10. HIPAA-Adjacent Disclaimer

roverIQ, Inc. is not a covered entity or business associate under HIPAA.
You agree not to submit protected health information (PHI). Any health-related data submitted is at your own risk, and roverIQ, Inc. disclaims all related liability.

 

11. Children’s Privacy

The Services are not intended for individuals under 13 (or under 16 where applicable). roverIQ, Inc. disclaims responsibility for age misrepresentation.

 

12. Third-Party Services

roverIQ, Inc. is not responsible for third-party privacy practices, security, or content. Use is at your own risk.

 

13. CLICKWRAP CONSENT & ACCEPTANCE

By clicking “Get Started,” “Learn More,” “Contact Us,” or similar, you affirmatively:

  • Consent to this Privacy Policy

  • Consent to SMS communications as described above

  • Agree to binding arbitration, jury trial waiver, class action waiver, and PAGA waiver

This constitutes a legally binding clickwrap agreement with roverIQ, Inc.

 

14. DISPUTE RESOLUTION, ARBITRATION & WAIVERS

14.1 Mandatory Informal Resolution & Mediation

Disputes must first be submitted in writing to hello@roverai.iq.
If unresolved after 30 days, the parties agree to mandatory good-faith mediation administered by JAMS in San Francisco County, California.

Mediation is a condition precedent to arbitration.

 

14.2 Binding Arbitration (JAMS)

Any dispute arising out of or relating to this Policy or the Services shall be resolved exclusively by binding arbitration, administered by JAMS under its Comprehensive Arbitration Rules.

  • Venue: San Francisco County, California

  • Arbitrator has exclusive authority over enforceability and interpretation

  • Judgment may be entered in any court of competent jurisdiction

 

14.3 Waiver of Jury Trial

YOU AND roverIQ, Inc. EXPRESSLY WAIVE ANY RIGHT TO A JURY TRIAL.

 

14.4 Class & Representative Action Waiver

Disputes must be brought only on an individual basis.
No class, collective, representative, or consolidated actions are permitted.

If this waiver is found unenforceable, the arbitration provision is void.

 

14.5 California PAGA Waiver

To the maximum extent permitted by law, you waive the right to bring Private Attorneys General Act (PAGA) claims on a representative or collective basis. Any PAGA claims must be brought individually and limited to alleged violations applicable to you alone.

 

14.6 Governing Law

This Policy is governed by the laws of the State of California, without regard to conflict-of-law principles.

 

14.7 Equitable Relief

roverIQ, Inc. may seek injunctive or equitable relief in court to protect intellectual property or confidential information.

 

14.8 Severability & Survival

If any provision is unenforceable, the remainder remains in effect.
This section survives termination.

 

15. Changes to This Policy

We may update this Policy at any time. Continued use constitutes acceptance.
